New Jersey at a Glance
New Jersey has one of the most distinctive personal injury frameworks in the country — its two-tier "Basic" vs "Standard" auto insurance system with a "verbal threshold" (limitation on lawsuit) that bars most pain and suffering claims for one category of insured. This election affects nearly every NJ motor vehicle case and directly influences case value.
The Verbal Threshold (N.J.S.A. §39:6A-8(a))
Plaintiffs subject to the "limitation on lawsuit" (verbal threshold) must prove one of six categories of injury to sue for pain and suffering:
- Death.
- Dismemberment.
- Significant disfigurement or scarring.
- Displaced fracture.
- Loss of a fetus.
- Permanent injury: bodily part or organ has not healed to function normally and will not with further treatment.
Without one of these, the plaintiff can recover economic damages (medical bills, lost wages) but not pain and suffering. Soft-tissue and non-permanent injuries fail the threshold and cannot support tort claims.
Comparative Fault (N.J.S.A. §2A:15-5.1)
Modified comparative fault with 50% bar. Plaintiffs less than 50% at fault recover reduced damages; plaintiffs 50%+ recover nothing.
Damage Caps
No cap on non-economic or total damages in personal injury cases. Med mal punitive damages capped at $350K or 5× compensatory, whichever is greater.
Statute of Limitations
| Case type | Statute (years) |
|---|---|
| Personal injury | 2 |
| Medical malpractice | 2 (discovery rule) |
| Wrongful death | 2 |
| Product liability | 2 |
| Tort claims against public entities | 2 years plus 90-day notice |
Auto Insurance Minimums and Policy Election
Basic Policy: $5K PIP, $10K property damage, no bodily injury liability required. Cheap; carries the verbal threshold automatically. Most cost-conscious drivers select this.
Standard Policy: $15K/$30K BI, $5K property damage, $15K PIP. Verbal threshold applies by default; policyholder may elect "no threshold" (also called "no limitation on lawsuit") for higher premium.
UM/UIM coverage is offered on both policies.
Pre-Settlement Funding Regulatory Status
New Jersey has no dedicated pre-settlement funding statute. The NJ Consumer Fraud Act (N.J.S.A. §56:8-1 et seq.) applies to deceptive practices. Standard contract law governs enforcement.
NJ Court System
New Jersey Superior Court is the general jurisdiction civil trial court, organized into 15 vicinages. Appeals go to the Appellate Division; the NJ Supreme Court takes discretionary review. Federal cases can be filed in the District of New Jersey.
Notable NJ Verdict Venues
- Essex County (Newark): Strong plaintiff verdict trends.
- Hudson County (Jersey City): Similar strong verdicts.
- Middlesex, Union Counties: Balanced with moderate plaintiff trends.
- Rural southern NJ: More defense-friendly.
The Bottom Line
New Jersey's insurance-policy election is the dominant variable in most motor vehicle cases. Confirm which policy tier applies before assuming case value. Funders underwrite verbal-threshold cases carefully. Cases that clear the threshold — or that involve non-motor-vehicle claims — fund on standard terms.
Instabridge Funding underwrites cases across all fifty states, with pricing and offer sizing that reflect the specific rules of the state your case sits in.
