The Philips CPAP Litigation at a Glance

In June 2021, Philips Respironics recalled approximately 15 million CPAP, BiPAP, and mechanical ventilator devices due to concerns that the polyester-based polyurethane (PE-PUR) sound abatement foam degrades over time. Degraded foam particles and off-gassed chemicals can be inhaled by users. Plaintiffs allege the exposure caused cancers, respiratory illnesses, and other conditions.

MDL 3014 Formation and Status

The JPML consolidated federal Philips CPAP cases in MDL 3014 in the Western District of Pennsylvania before Judge Joy Flowers Conti in October 2021. Two case tracks emerged:

Economic Loss Settlement (October 2024)
